Regarding stay order

Dear Sir,Please advice me.
Reason: My dad had purchased land 3 gunthas in 1973, for which we have agreement.We have buildup our house in just 2 gunthas, balance 1 guntha was left vacant for surrounding.Touching our plot there is other plot of some other owner,when my dad purchase our plot he didnot put any marking indicating our area & my dad has expired now.
Issue: The other owner who has plot touching our plot has decided to build a house in that area, and he is illigeally using our area with his area.So I want to bring stay order on his construction.Let first count the land put marking and then he can build his house. Please help me what should I do further to make him stop the work.
Please revert urgently he has started with construction work.

Thank you sir for your reply.
Actually I have no knowledge about any laws, so please explain me the procedure to get stay order from civil court. I stay in Vasai west,Thane. Also let me know if this court matter will harm my career in anyway..? as I basically work abroad. Also let me how much it will cost approx.

You live abroad and civil suit do require concentration and constant perusal and persuasion by the litigant so if your conditions allow you or your General power of attorney only then decide to initiate timely action against your neighbour.
First of all, you shall have to get the demarcation of your are from the office of local Talathi by putting an application and offering the desired/requisite fee and on the basis of report of the demarcation of the area, should engage a local lawyer and then should follow his advice.
