REGARDING SUSPENSION OF BANK OFFICER IN NATIONALISED BANK -

I AM SUSPENDED BR. MANAGER OF DENA BANK SINCE 25/11/2009,FOUR TIME APPEALS MADE FOR REVOCATION, BUT NOT RESPONDED BY BANK.
CHARGESHEET ISSUEDON 16/04/2010 BUT RECEIVED ON 20/05/2010.EIGHT TIME APPEALS MADE TO PROVIDE MATERIAL FOR REPLY OF CHARGESHEET BUT NOT RESPONDED BY BANK TILL TODAY.GETTING SUBSISTANCE ALL.1/3 OF SALARY FOR THREE MONTHS AFTER SUSPENSION AND 1/2AFTER THREE MONTHS.
NOW, WHAT TO DO ?
PLEASE GUIDE ME

Does the bank constitute the disciplinary committee and start the inquiry? After it submits its report , ypu could challenge the same in CAT.If otherwise you are aggrieved then move the CAT right now.

No Sir, Bank has not constituted the disciplinary committee and not started the
inquiry because inspite of eight time appeals made to Bank to provide me the material for reply of the chargesheet, bank has not provided the same till today, so what to do? Also please tell me the meaning of CAT.

Only after the reply to the charges is furnished by the delinquent,it would be studied and in case the management is not satisfied with that explanation,then an enquiry officer would be nominated to proced with the enquiry into the charges. Now,it is premature to say that the disciplinary committee is not constituted.How can you ask the enquiry to commence without submitting your explanation? You keep on insisting for the documents that are required for submitting your reply. If they do not furnish that would be ground for you to approach the high court by way of a writ allging violation of principles of natural justice and seek those records. But as a matter of prudence,it would be safe not to raise that objection now at all. If they are not furnished to you that would be a very strong and substantial ground for you to challenge the findings of the enquiry officer at a later stage on the ground sof violation of principles of natural justice.

But the officer can seek guidance from Association who can raise this issue to the Management seeking grounds for chargesheet.
