Dear Learned Members,
I belong to the state of Gujarat, while my fiance belongs to the State of Bihar. My query is, whether we can legally get married in any other State, for Eg: Delhi, Mumbai, etc. Also whether A lawyer can get us married legally or do we have to opt for the process in the Court and also the expenditure that will be incurred in the process
Your advice in the given matter will be highly appreciated.

if you want to marry under special marriage act you have to satisfy the requirements laid down
Section 5 of Special Marriage Act – 1954 states that “when a marriage is intended to be solemnized under this Act, the parties to the marriage shall give notice thereof in writing in the form specified in the Second Schedule to the Marriage Officer of the district in which at least one of the parties of the marriage has resided for a period of not less than thirty days immediately preceding the date on which such notice is given.” The above mentioned Section talks about the address proof of only one of the marrying couple. But, almost all the Marriage Officers push the marrying couple to submit their respective address proofs. The marriage solemnization is denied where only one of the couple has the address proof

Sir, we are marrying against the wishes of our parents and we need to get married with the assistance of a lawyer in a State other than our residential State. Kindly guide us in the given matter.

you need residence proof as mentioned in my reply . 30 days notice is necessary .

Can we not take help of an advocate and go for a shorter notice period? I have seen couples getting married in one single day with the help of Learned Advocate.

Both parties alongwith 3 witnesses are required to be present on the date of solemnisation of marriage.

i dont do any short cuts .
you have to furnish residence proof of mumbai if you are getting married in mumbai
admittedly in your case proof is of gujrat or patna
your marriage cannot be done in Mumbai

Better go with the law and procedure, don,t try to adopt shortcuts.
Contact a local lawyer of your place where you are living.
