Registering property that was in my fathers name.

Hi,

We have a house registered in my Fathers name. Unfortunately, My father is no more. I have 3 sisters and all are married and well settled. My mother stays with me. And she want to register that house in my name. How do we proceed on this?

If your father was owner of this house then in case he died intestate the property has devolved equally upon his Mother(in case she
is alive),his widow(your mother),all daughters as well as on all sons.(I suppose it is a Hindu case of succession).

To get it one name(say in your name)all others would be required to execute a registered QUIT DEED (say relinquishment deed).

your mother and sister have to sign relinquishment deed in your favour . have said document duly stamped and regsitered . then only the property can be trnasferred in your name .

Your father died intestate then the property will be devolved among your father's mother if she is alive, your mother, your sisters and brothers equally. For transferring this property in your name all the others heirs have to execute relinquishment deed in your favour.

All your sisters and mother jointly can release their share in your name.
