Mrs.Roshan Dalvi,J. passed an judgement/order in that case, she stated that " since in suit for specific performance, the agreement is not required to be registered under proviso of Sec. 47 of Indian Registration Act and since the registered agreement are not relied upon to proove damages by owners, the documents may be seen and read in evidence by both parties.
please give Exact meaning to above mentioned para.

Kindly provide entire judgement/order so that we can give correct reply. As for as this para contains Agreement is need not to be registered as per sec 47 of Indian Registration act. In the specific performance suit mainly readiness and willingness is must.

The relevant paragraph of the judgment is very clear that the judge has observed that there is no need for the registration of the agreement to sale under section 47 of Registration Act as such the plaintiff is entitled to sue under the provisions of specific performance act.

If possession of property has been given to purchaser prior to execution of sale deed than registrtion of agreement is must as per sec 17 of Registration Act.
