Though customary divorce is recognised by the Act the existence of such customary divorce is very difficult to prove.

yes if there is a long and unitrrupt custom in ur community then its recognised by the act itself but its true that its very difficult to prove. so its better for you to take divorce decree fr concerning family court either by mutual consent or by the help of section 13 hindu marriage act wat ever u like.

You are a Hindu. Hindu Law applies. You need to get divorce in accordance with law. Even though your marriage is not registered, admitted fact is that you are married. You cannot take divorce by signing a stamp paper in the presence of sarpanchs. One time payment for maintenance may be made provided the other party accepts the amount. But decree of divorce from a court of law is essential.
