I gather that reg. of sale agreement is now mandatory by law? But builder of flat is refusing to register sale agreement. He asys it is not necessary. How can I force him to register the same quickly? Can I have it registered myself at sub-registrar office in absence of builder -- after all he has executed the same by signing it. Please help me out. Thanks and regards.

hi dear u r not mention in your query where u booked the said flat. But in common and as per the state laws where u reside every builder has to registered the sale agreement with purchaser towards the advance payment he received is more than the prescribed amount i.e. in maharashtra state if the advance amount is more than 20% then builder has to registered the sale agreement otherwise purchaser can sue him under mofa act

In Banglore also such agreement is compulsorily registrable. You issue him a notice a seek its registration.

Dear Reader Any transfer of property more than worth one hundred rupees must be through a registered sale deed. So you must compel you builder to get it registered in you name or else you may deprieve of your right, title and interest over the said property in future.
