(Querist) 28 May 2014 This query is : Resolved
I am owner of one flat at Boisar, Thane (Maharashtra).I am goint to enter in tenancy agreement with some one for 11 months with monthly rent of Rs.4000/-. Please inform me whether 11 months agreement requires mandatory Registration. Is there any risk in renewing the same for next 11 months?

Lawyer SALEEMA KABEER (Expert) 28 May 2014
There is no need to register the rental agreement if it does not exceed for the period of 11 months as per Law existing in Tamilnadu.

At the option of both parties it can be renewed even after 11 months. There is no risk. On the other hand, it will help you to exercise your option.

This type of agreement is also known as "Leave & Licence". I requires no registration.
My answer only emphasises what has been stated by the above respondent.

In WB too leave and license agreement unless registered is treated as tenancy agreement under rent Act only.

There is no legal requirement to get the registration of such agreement as the same is for the 11 months except for the State of Maharashtra
Adv.S.A.N.Baroodkar (Expert) 30 May 2014
get the agreement registered at register officer and you can have a renewal clause in the agreement in both the parties to agreement want it. what you are talking is nothing but a leave and license and it requires registration. for the safety of the both the parties
