Rejection of name from voter's list

(Querist) 12 September 2015 This query is : Resolved
I am a voter of Diamond Harbour Assembly Constituency (under Diamond Harbour Parliamentary Constituency) from West Bengal, India. By Profession I am an Assistant Teacher in a Govt. sponsored higher secondary school. For my job I am living in a rented house 80 K.M. away from my permanent residence for the last six years with my family. My permanent residence is empty and locked. At the time of last Parliamentary Election in 2014, I came to know that my name along with my family members' has been deleted from the voters' List without any correspondence!
I usually cast my vote through postal ballot (ED Vote) as, being a govt. employee, I am to perform election duty at the time of each and every election. Last time it was impossible due to the deletion.
My query is-
1. Is the deletion legal?
2. What is the legal procedure to delete a voter's name from the Voters' List?
3. If it is illegal, whom can I challenge and how?
Sudhir Kumar, Advocate (Expert) 12 September 2015
1. Is the deletion legal?

WHILE HAVING BEEN ON ELECTION DUTY SEVERAL TIMES YOU SHOULD BE AWARE THAT THERE IS AN ASD LIST PREPARED BY BLO.

You were not entitled to maintain your registration at old address as you were not Preside/Vice President/ MP/MLA/ Defence Person / Person working in Indian Mission abroad.

SINCE YOU ARE NOT RESIDING ON THE SAID ADDRESS DELETION IS LEGAL. IF YOU HAVE NOT REGISTERED AT NEW PLACE OF RESIDENCE THEN IT IS YOUR PERIL.

2. What is the legal procedure to delete a voter's name from the Voters' List?

REGISTER AT VRC THE PLACE WHERE YOU ARE NOT RESIDING

You can get your name in the place you are employed and residing.

Q 1 & 3. Yes valid. You are entitled to cast your vote where you are residing, did you not get your (and your family member's) name changed in the Diamond Harbour Constituency?? If not, you must do it before any next elections.
Q2. Your residence verfication by BLO shall be conclusive proof for addition/deleltion/amendment in the local election list of voters. However, it is an academic question (procedure) to be found out from books/election commissio.
T. Kalaiselvan, Advocate (Expert) 20 September 2015
You can get your name listed in the place of your residence proving the deletion in the previous place.
