I am going through a court matter in the family court for a divorce. My wife had on her own accord without my knowledge left the house and filed the divorce. Is it easy to get a record of sms's of mine from the service operator and would it be easy to prove in court and would it be legally accepted by the court. Regards

in the matter of divorce you have also to state the reasons of separation also and the SMS is included as one of the evidence in the support the communication during the separation and in this case your wife also can produce the other communication which you have sent her

Dear Advocate Bishnoi, I am talking about after she left the house and filed a divorce and after a year or so of that if I am or some third party is smsing each other and not to my wife, then is it easy to go and obtain that sms list from the service provider and would that be useful as evidence in court. Regards

If you and any third party is smsing each other and if the same comes within objectionable definition within the knowledge of your wife then its record can be got summoned through court on the request of your wife from the service provider.

yes.i am agreed to mr.raj kumar makkad.bcoz in family matters courts are little bit tilted towards woman and in such a case if court can pass any such order(as mr.makkad said),just to expediant the ends of justice or as it deems fit.

If SMS contain any relevant proof to show before the Court ,then she can use it as proof .
