Release deed

(Querist) 19 June 2022 This query is : Resolved
My uncle (Tauji) relinquished his and his minor siblings rights in two properties inherited on death of his father to my father and his siblings by way of release deed in 1971. I am the elder son of my father. Does I get rights on these two properties as is mentioned in the release deed.

Did you state that your uncle and his minor siblings or sons and in favour of your father and his siblings? to my understanding, your uncle and his minor children relinquished rights over the inherited property to your father and other brothers also. So after your father, you and your mother and your siblings have equal share over the property of your father's share only.

The remaining brothers of your father did not relinquish/release their rights. hence you will have only an equal share of your father's share with other legal heirs of your father.

Very well analysed, opined and advised by senior expert Mr. Kavksatyanarayana, I concur and appreciate.

Your uncle has relinquished his share ONLY, in favour of all his siblings (including your father).

You have a share in the properties owned by your father ONLY.

How is that the grandsons are having rights in the grandfather's property? It appears that facts are misconceived.
