amar (Querist) 14 February 2015
Cibil says they have set of match rulesl like pan date of birth address name etc and during processing of CIR there is chances of overlap of data belongs to similar identity. Is it a ground to provid default in any body cibil report. such happened in my brother case.
Guest (Expert) 14 February 2015
PAN cannot be the same for some other person. There must be some human error. First check where and what type of data error exists.

Write to both M/s CIBIL, ICICI and demand to supply the certified copies of communications sent to M/s CIBIL,sent by M/s CIBIL and depending upon what was exchanged let them state whatever they want........

You can write to Governor RBI, Ministry of Finance and demand to levy exemplary penalty and punishment!

If no reply is received or if the reply is dis satisfactory pull them to court of law................ civil suit with damages can be rewarding............criminal case of defamation might be possible.....

Cibil provides the information received from the Banks. If any information is wrong with the CIBIL, take up with the concerned Bank.
Kumar Doab (Expert) 14 February 2015
M/s CIBIL is fully responsible for any error committed by it:::::be it manual or entry in register manually or overlapping in computers as stated by it.............

The law of land of Republic of India has not granted such special status to M/s CIBIL, that all lapses/faults/transgressions/defaults/deficiencies committed by it are pardonable!

M/s ICICI, M/s CIBIL are fully responsible for all faults, errors, transgressions committed by them.

Consult your lawyer with all docs on record.

When once the mistake stands rectified on being pointed out - I wonder what else is left still to be agitated?

ajay sethi (Expert) 14 February 2015
CiBIL has corrected its records . period

why you want to waste your time and money in running around courts and on legal fees?
Kumar Doab (Expert) 14 February 2015
Your query was if any action can be taken!

Yes it can be taken.

Various other factors that you may put up to your lawyer are that: if you paid any fee for correction, any dispute form you submitted at your cost, any representations you submitted to M/s ICICI,M/s CIBIL, any defamation/loss/harassment/mental tension/agony you suffered, did you demand begging for apology and did M/s ICICI,M/s CIBIL tender apology in writing, did you demand to supply you the compensation policy and compensation and was it supplied to you....................etc....

Your lawyer can appraise you on the merits..

Both M/s ICICI,M/s CIBIL may get penalized if you lodge complaint with authorities.

If you are confident then you can handle the matter on your own or any NGO,Consumer help group can also represent you....and may opine that you are sure to get the compensation......

Decide after discussing with your counsel in person.
