Remedy for delay in hearing of notice of motion for early hearing

(Querist) 01 February 2012 This query is : Resolved 
writ petition in original side admitted in Bombay high court in 2007.

the matter did not come up for hearing.

Notice of motion for speedy hearing of the case was filed in September 2011 as the petitioner was a senior citizen under distress.

The matter was to come up for hearing in the 1st week of October 2011, but has not been listed until date.

What is the further remedy available to the concerned petitioner for expediting the case. Please guide

you have to make an application before the chief Justice have the case papers produced for expediting final hearing of writ .

Apart from that do ' MENTION' the matter when the court sits in the morning.

There is no other remedy but to again move similar application mentioning the earlier order.

precipe can be filed and matter be taken for hearing with notice to other party. i think 48 hrs is the time after filing precipe. did u try circulation?

meantime the concerned judges of the division bench have been transferred and reallocated different duties on the 31st January. hence there is further delay.
