Renewal of passport

(Querist) 17 December 2012 This query is : Resolved
Dear Learned Experts

I have a pending divorce proceeding (initiated by my husband) at the Family Court since 2009.

If the enquiry had happened in the due time, the case would have been closed by now and there were high chances of reunion but till now, unfortunately the enquiry is postponed for no reason

However, i am still waiting for reunion only.

Meanwhile, my passport is to be renewed as it is getting expired in July 2013.
Since I may have to travel abroad for short period during mid next year, I want to do the renewal well in advance.

For this, my marital status is a hindrance, as my marriage which happened in the year 2009 was not registered and in the same year my husband filed for divorce.

Now, I may have the other listed proofs of address but as regards my marital status, i have to mention to the passport authorities that I am married but there is a divorce proceeding going on , and I am waiting and contesting for rejoining my husband.

In this situation, will my renewal be done by the PP authorities or What is the solution to get the renewal done ?

If my PP can be rejected on non submission of marriage registration certificate, how can i overcome that and what declaration should I make?

Please advise

Thanks

You have to show your status as married. Pendency of divorce suit is of no status.
The divorce suit is a proof of marriage.

You should not suppress the true facts from the authorities.

Sirs,
Thanks for your response.
I will definetly provide only the true facts to the authorities
my concern is because i am not able to provide marriage certificate, will my pp renewal be rejected?

Do i have to provide any legal forms for the PP authorities to accept my pp renewal , consider my married status without a marriage certificate , because married couples who have not registered their marriage, have to give a declaration through a notary public to the PP authorities, similarly what should I do ?

you also submit declartaion that you are married and at present dvroce case is pending in famly court . have said affidavit affirmed before notary

Affidavit attested by Notary Public is also a proof but better to enclose the certified copy of the petition filed by your wife wherein the factum of your marriage is reflecting there.
