Rent agreement

(Querist) 13 February 2014 This query is : Resolved 
I have given my flat on rent for 11 months and now tenant wants to vacate it before 11 months. For this he gave oral intimation n asked to return security deposit within 1 month. I am not in condition to give him dat amount but ready to return it after 11 months only.
My query is can i oppose it legally coz such particular clause is not included in our agreement. and he warned me if I wont give him security amount within 1 month he will file case against me.
Plz Guide me..

if there is no such clause in agreement regarding termination of leave and license agreement you also orally reply to licensee. inform him that SD would be given on expiry of agreement

in case he files case mention you are willing to return SD on expiry of agreement. as it is only oral notice has been given .till date he has not issued any written notice .

Agree with the expert ajay sethi ji, for oral demand oral reply, if written notice received, reply as per contents of notice through your lawyer.

Yes, i agree that for an oral notice, give oral reply and for written notice, mention the facts and agree to return the security deposit amount after the expiry agreement period quoting the agreement clause.9wich is silent about refund within the agreement period).
