i gave a shop on rent, but we did not make agreement because he gives only Rs.10000/- as security deposit and say remaining balance of Rs.15000/- will give afterward, now there one year have been done but he did not give any deposit yet but gives a rent on time, now we say firmly for our balance deposit then he say "Go what can you do i will see" then i decide to file case but whether we have to do police complaint for this or go directly in court and how to file case in court.......pls advise thank in advance

You can do nothing about the balance security deposit.
However if you want the shop back then you can file a suit for eviction against hin after sending him a notice of eviction.

you have no written agreement . however licencee is paying rent on time .
you want balance security depoist of rs 15,000 which he has declined to pay .
tim eand time again we have requested querists to consult a lawyer before giving premises on leave and licence basis .
for saving few thousand rupees you are in bigger mess .
contact a local lawyer and request licencee to vacate the premises . if he fails to do so file suit for eviction .
try for an amicable settlement now rather than going to court

Any dispute, and you may not get possession, and he can claim standard rent, and may not vacate. So be very careful, and see that he vacate your shop back, or u will have it!!
