Dear Experts, Husband ready to pay rent on behalf of wife and ready to arrange accommodation in same area where husband is living but wife not agreeing for same.wife is insisting to stay where husband is staying.judge is asking husband to let wife stay with him at his place but husband is denying.divorce petition filed by husband
How maintenance is calculated please give your opinion on both the issues

Legally, you can't deny stay of wife with you against her wishes, until the divorce is granted. You have to convince her about peace of mind, if both of you stay separate till your cases of divorce and maintenance, if applied by wife) are decided.

Dear Experts,
Thank you for your views. What husband wants understand is the ways to keep her away because she wants to come back to harass husband . Regarding maintenance husband salary is 45000 monthly and house emi is 8000.
Wife salary is 25000 monthly and better qualified than husband.
1)In above case how maintenance will be calculated.
2)husband will keep a proposal in court that he is willing to give accommodation separately.
3)can wife demand to stay in same place where husband is staying.
Please give your valuable suggestions.

U R saying that the judge has permitted her to stay in UR house,U have to obey till the divorce petition is disposed off.Maintenance has to be paid for her minus the rent.

Since the court has not passed any order against the husband to accommodate his wife in his own home, he can very well reject the suggestion made and can insist on the alternative accommodation he proposes o provide, there is nothing wrong or illegality in it.
As far as the maintenance is concerned, since she is employed and earning a handsome salary, it will be a strong ground to repudiate her claim.
