Rented house and future rights to married daughter

(Querist) 08 January 2014 This query is : Resolved
My grandmom(mother's mom) is staying in a rented room. The owner of her chawl asked to evacuate the whole chawl.

My grandmom stays there and she is very old. My mom goes there and stays in between but obviously doesnt stay there always. So is there any hope that if we fight the case my mom will get tenant rights?

TO add, my mom dont have aadhar card /ration/ any other proof on that chawl room address.

Is there any hope? Please advice. Thank you.

Does your grandmother (Nani) have any male decendant? if yes, he may get protection against eviction from tenanted premises.
Devajyoti Barman (Expert) 09 January 2014
Ask your grand mother to gift the tenancy right in favour of your mother. Then your mother can fight the eviction.

Contact a local lawyer and discuss with him all aspects in light of the local law.

your grand mother must be having rent receipts in her name . she should refuse to vacate .

a tenant is not a prisoner who will always be living in chawl.

The daughter is having the right over the rented property, if she can able to prove the tenancy of her mother.

If there are any other legal heirs, the daughter ought to get NOC from them.

Above all the daughter should establish the need of that rented property for her usage not for sub-rent.

Thank you everyone for your advise. Grandmother dont have rent receipts in her name as the owner never transferred the room to her name since the death of my grand father.

We kept giving the rent but name is of grandfather.
T. Kalaiselvan, Advocate Online (Expert) 12 January 2014
First the tenancy is to transferred to your grandmother from her husband's name and then only other procedures can be thought about.
