In the FIR which I filed, High court dismissed the quash petition as should not quash. But magistrate court closed the FIR with the closure report from police.
Now I want to open it.
Should I try open in same magistrate court or sessions court? Kindly help.

What is your locus standie to the statement posted by you?
How does it got quashed by High Court ?
Under which provision of law you want to reopen before Magistrate when it is stated to have been quashed?
Re-fabricate and re-frame this question paper, if there is "some" truth.

FIR closure on the closure report of the police in section 498A etc.IPC complaint case are not closed by the Magistrate unless the complainant/wife is given opportunity to raise her objection against the closure report. If Magistrate didn't give notice to the complainant wife to raise her objections the closure of the case can be reopened by moving the Session Court for appropriate relief by the complainant wife.
