(Querist) 24 March 2013 This query is : Resolved
Dear Sir
My name ANANDA KRISHNAN.V residing at Pondicherry in which me started construction of house on Nov`12, Reddiarplayam , Pondicherry.

In which I constructed house unknowingly (plot no -23 shown while purchase ) in which I incurred about Rs.6 Lacs before roof stage by my me for construction of house and then afterward ie on Feb`13 they came and stopped the construction so we stopped (i.e owner of the plot 23)

Sir they realized only after 3 months which is also their mistake (as per law)

But me started construction at plot no 19 of same cross after the above incident which is my actual plot to be constructed , further my application for EB,PPA and others all for Plot No:19

Sir it is a mistake from my side, but me decided to claim the above amount from them but they are not interested further they as per law kept quiet for 3 months to see our construction

Sir as per law give ur suggestions but please remember my motive is to not to take plot 23 as i have done mistake but soon i started construction at plot no:19 in which i am the owner of the plot

Ur advice please at the earliest and send thro mail:

anandakrishnan2005v@rediffmail.com

Regards

ANANDA KRISHNAN.V

query is not clear.
For any of your mistake you can not claim your money back.
Raj Kumar Makkad (Expert) 25 March 2013
Legally one cannot get the compensation or the cost of his mistakenly done some work on the property of others but in practical life, such things can be raised. If your neighbour is not listening to your advice then it shall be better to minimise your losses by demolishing the construction thereto and shift the material for your own use.

i too agreed with mr barman and makkad, it is your mistake , only way you make convince the real owner of the plot and better to get some money with his wish , you can not demand him, if he ready to pay some of amount then you are lucky
Adv k . mahesh (Expert) 25 March 2013
the mistake was on the registered deed so the municipal authorities how come they gave permission to you to construct the plot
and i think even you have taken permission for borwell and what about that permission
Raj Kumar Makkad (Expert) 26 March 2013
-k. mehesh! borwell permission is not required all over India and even the author has not mentioned about anything wrong with his registered sale-deed.
