Report u/s 202 crpc

After recording preliminary evidence ,Court has ordered to SHO cxoncerned police station to submit report us 202 crpc in a criminal complaint case,if police found allegations to be true than police can register FIR or police can file/submit its report with a finding that allegation of complaint are found correct and true in their investigation.kindly advice.Regards

There is no order to register FIR, hence it is discretion of police. It is necessary to submit report to court whatever it. If the police register FIR also, it will submit charge sheet later, and both complaint and charge sheet will merge as Section 210 Cr.P.C and it will run as state case.

if the the order of the court to police u/s 202 that police can act only after orders of the court which court may pass after submission of report to it.

Since the cognizance is taken , question of FIR does not arise at all.Police have to submit report about the correctness of the complaint and its findings if anyfor consideration of the Magistrate. Uma Parmeswaran is correct.
