Querist : Anonymous (Querist) 28 March 2010 This query is : Resolved 
Dear sir,
My father died in 1984, before that he made a will which was registered in1982.
As per the will , the property left by him is to be equally divided by the three sons out of five sons and three daughters. as per the will he has already given the shares to two sons and three daughters.At present out of three daughters only one is alive.Now we three brothers want to probate the will. Kindly request advice what is to be done and how long will it take.

You can definitely take probate of the will for which you have to make an application before the District Delegate. Giving citations upon the legal heirs of the legatees and their consent is a must for undisputed taking of probate.

You can apply for probate making all the legal heirs party.The share of your two deceased sister will go to their legal heirs,if both are unmarried then it will divided equally to all the legal heir of your father.If will is undisputed then it will take six month time approximatly.
