Requisition of Suit Proceedings Documents.

Respected Sir/Mam,
A suit had been filed in Hon. Bombay High Court during 1980 by two plot owners adjacent to my plot situated in mumbai suburban and the said suit decreed in the same year.

Now i have come to know that my plot had been affected due to the said decree so please guide me that can i officially apply in the court to obtain all the documents, plans submitted during the said Suit proceedings?

As i have to file a new suit on the basis of those documents.

The information you received may not be correct. The Original Side of the Mumbai High Court seldom decrees suits so fast!

If your plot is affected, either you or your predecessors in title would have been a necessary party.

It is possible that i could get the certified copies of all suit proceedings docs i.e. Plaints, Replys, Rejoinders, Roznama, Plans and maps submitted during the said period even after i am not a party in the said suit.

U R not a party to the suit, So, the decree passed therein is not binding on U. Don't waste time, File a suit for protection of your rights. U will have to prove your case with the help of your docs, irrespective of the decree passed in the suit.

You can file a fresh suit for the cause of action that arose now which is affecting your interests and rights.
