Restoration of conjugal rights, domestic violence & alimony

(Querist) 16 November 2014 This query is : Resolved
My marriage was done on 07.03.2014.
After marriage my wife gone with his father without "bidai". We had no physical relational coz my wife don't like before 2 years.
I had recorded our telephonic conversation for future record.
My wife want to live with us but my father in law don't.
I had file a case for Restoration of conjugal rights on 27.03.2014
But now my wife had file a case for Domestic violence & Alimony.

Points
1) We had no physical relational
2) Wife wants to live with us (recorded by phone) but his family didn't.
3) If she was Assault by us on 07.06.2014 then why not she file FIR and how she go his fathers home.
4) If His examination ends on 10.06.2014 then how can she come.
5) I file a case on 27.03.2014 for Restoration of conjugal rights but she had file case on 02.10.2014 for Domestic violence & Alimony.

What points help me and how.
Now what can I do.

Fight the case of DV on merit.
if she is unemployed, you can not avoid maintenance.
Talk privately with your wife. I think you case is fit to be resolved amicably.
Do not depend on court to reunite both of you.

you cant force your wife to stay with you . even if you obtain decree of RCR your wife may refuse to stay with you . fight DV case on merits

Dear,

You guys better sit and settle the matter, she is being tutored by her father for all the litigation .....tell her and court that we want to stay togather.....better file a complaint of abduction against her father.....

After filing of the case of RCR domestic violence case is likely to be filed by her. Better talk to her and if she wants to live with you try to settle the matter. May take help of common friends.

You have to defend the DV case on merits. If she is not employed, maintenance has to be paid.

If you can prove that she deserted the matrimonial home on her own and that you are ready to take her back but she is adamantly not willing to come back, hen there are chances that her maintenance case to go against her. In DV case, you have no option than to challenge the same properly to come out of the case without any injury.
