I am Amish Dadawala from Vadodara Gujarat; my family is agriculturist family since 1923 as per Revenue Records available form this period to till date.
My Query is; as per current revenue records the said land is on the name of my Grand Father’s Grand Father’s name. It’s under possession of my extended family members. They are not sole owners of this land as per one of the judgment of Honorable Gujarat High court. The said land is for sole purpose of family welfare and a Shivji’s temple located in land. The Judgment also specifies that all family members have to appoint an administrator jointly by the way of election for the land and mandir’s administration. At the same time no one is authorized to sell this land in future.
Now coming to main point; I want to buy an agriculture land in Gujarat State. Can I use my legal rights of a grand son of a grand son of a person who is Agriculturist as per latest Revenue Records? I know the normal and usual way to buy an agriculture land in Gujarat Sate; which is if I own an agriculture land I can buy another. For the same I need to update my name with this existing land revenue records by the way of “Family tree” authorized by “Talati”.
Now here there is one more query I don’t know all family members and I am not able to collect data of my extended family members as they migrated to another country some years ago.
Now is it possible to buy an agriculture land in lawful manner in Gujarat State using my rights as a family member of an agriculturist…?
For experts reference; the exact word in revenue records (7/12) are “Nominee of Late Shri Bhagubhai Dadawala and as administrator of Shri Nilkantheshwar Mahdev Mandir of said land. The type of land is “Juni Sarat” in other words this is an agriculture land.

The entries of the 7/12 extracts duly fulfil your requirement. You have by way of documentary evidence have to prove that you come within the legal heirs of Shri Bhagubhai Dadawala. If this is duly proved, Talathi shalll issue a certificate of agriculturist in your favour which shall be sufficient to purchase agricultural land in either of the parts in Gujarat.
The process of mutation of the land is a very long process and is also tedious so better to opt it.

Firstly, after death of shri Bhagubhai Dadawala, you must entered all his legal heirs in the 7/12 , for this you have to submit a death certificate of Shri Bhagubhai and Affidavit duly signed before Executive magistrate/Tehsildar for all bonafied legal heirs to Talhathi. So as to applicable for other deceased person in your family too. Accordinly, your name will also been incorporated after mutation by Talhathi. You have to fulfil this procedural aspect of Revenue Dept. Once you obtained 7/12 of subject agricultural land having entered your name is suffice to have proof of an Agriculturist. Further you can buy another agricultural land on this 7/12 extract.
