Revision and Appeals

(Querist) 11 September 2008 This query is : Resolved
How can we differentiate the appeal against acquittal and revision against acquittal?

Kiran Kumar (Expert) 12 September 2008
pls refer to Sections 378(4), 397, 401 of the Cr.P.C first.

appeal against acquittal lies directly to High Court though the Cr.P.C was amended for the purpose the appeal against acquittal shall lie to Sessions Court but that amendment was not notified.

if in appeal against conviction before the sessions court the accused stands acqitted then one has to file Criminal Revision against that order in the High Court.

m keeping this query open, if m in correct then pls correct my knowledge.
