Owner is A
Agricultural Land is Gairmarusi
Occupant is B
What are the rights of A and B , when B refuses to vacate the land nor pays anything to A

Dear Expert ( Mr. Nair ).
Sir, this is a real issue not only an illustration. . For obvious reasons, identity of A and B is withheld. Any other details can be given, if asked for. In this case A has three more co-owners, of which two are hapless widows. It would be a great help to them, specially to widows. Thanks

The possession recorded of occupant is with consent of owner or without consent of owners???
If admitted as tenant since how long back they are not paying the rent.
As remedy a declaratory suit of injunction eviction and possession shall lie against their unauthorized occupancy by owners.
Better visit a local revenue lawyer for rest.

Respected Expert Mr. Prabhakar Singh.My thanks to you and I add as under;
In fact the land was in the name of their father, who died about ten years back. His heirs were not in the know of any land. When it came to their notice, they got the land mutated in the names of heirs. There is no rent for the last ten years and may be more than 10 years. In the revenue record, the occupants have been shown as gair marusi. They are showing adamancy to be owners by virtue of long possession. It appears to be a case of forced occupation from the time the real owner was alive.

I advise you to get the record inspected by a good revenue lawyer and the proceed for the suit i advised you.
