Road accident

(Querist) 15 March 2014 This query is : Resolved 
How is taken a trial in 304 A IPC on behalf of the defense side. In this fact that the deceased were crossed while on the national highways when hit the bus,he is dead on the spot and also accused name is mentioned to the FIR with eye witness. But FIR is registered delay with 11 hours and lodged a complaint the same.Please suggest to me.

Such delay is not damaging if explained properly.

The delay in registering the FIR cannot be construed as a strong defense, especially in the light of strong eye witness' evidence.
