RTI Act 2005

Guest (Querist) 11 January 2011 This query is : Resolved
An appeal was filed before CIC and allowed in favour of appellant.

Commission directed to supply the information to appellant and commission both.

commission issued show cause for not imposing penalty on PIO.

thereafter, neither the information was recieved by appellant nor any decision of penalty hearing was communicated to the appellant.

It was around a year ago.

1.Can I still file a complaint against the PIO for not following the directions of CIC ?
2.What to do to procure information, if it was sent to CIC but not to me ?
3.What to do for getting a copy of decision of penalty hearing ?

If, in any case, the Public Information Officer does not implement the order passed by the appellate authority and the appellate authority feels that intervention of higher authority is required to get his order implemented, he should bring the matter to the notice of the officer in
the public authority competent to take action against the Public lnformation Officer. Such competent officer shall take necessary action so as to ensure ~mplementation of the provisions of the RTI Act.
Hence, in your case you have to represent the position to the CIC for necessary action as per the RTI Act.

sure, you can file a complaint before central information commissioner and also you go file a complaint in proper consumer forum. Because a rti complainant is an consumer, when he pay the amount to receive anybody.
