Hi Sir,
I filed an RTI, regarding my degree pending since last two years asking for the cause of delay in degree and when will I get my degree.
I am B.tech(ECE) Passout of 2011 batch and not yet received my degree.
The RTI was filed by my mother asking about my degree.
Approx 35 days have passed I have not received any reply to my RTI from PIO(public information officer).
There is no Appelate authority details given on UPTU website , I want to know where should I now file appeal.
And what next steps should I take.
(Attached is my RTI application)origal copy sent to PIO was signed by applicant that is my mother.
Please help me, your help will be very usefull to me.

You can file the RTI appeal to the same address, instead of PIO, address to the Appellate authority under RTI Act.
The appellate authority will be sitting in the same office, but he sill be a higher officer than the PIO.
So, the address is same for both of them.

Thanks Mr. Arun Giri Sir for your kind response.
Do I need to again apply same way as I applied first time for RTI to PIO, UPTU Lucknow, and will the Postal Order will be again required, if Yes of what amount.
Secondly, The RTI was filed by my mother, is there any problem if RTI was filed by my mother and is there any kind of affidavit required stating relation with my Mother for that ??

Are you seeking information under RTI or seeking remedy of grievance.

Dear Sudhir Sir,
I have asked for the cause about not printing of Degree in UPTU ( as informed to me by my college). I am seeking a relief about the actual cause of not issuing me the degree and when will I get my degree.
I am not alone there are other more than 200 students from my college and there are thousands of students from 2011 batch who have not received degree (for students who gave special carry over examination conducted by university in 2011).
I don't know whether anybody has filed RTI other than me or not. But i know I am the only person who has filed RTI for my self from my particular college.
Your Valuable suggestion will be highly helpful.

File an appeal to the appellate authority. No fresh postal order need to be attached.

Mr.Gaurav -
1. Though you do have the name and address of the first appellate authority, you can send it to the known office of the University addressing the application to the First Appellate authority under RTI Act. You can as well send to Dr.R.K.Khandal, Vice-Chancellor of the University, who needs
to direct the same to appropriate officer (first appellate authority).
2. You need not pay the fee or enclose Postal Order/Demand Draft as you have already paid the same. You can make a mention in your appeal application that you have already paid the required fee and if any more fee (depending upon number of pages of reply - it is permitted to charge @ Rs.2 per page) is required to be paid, you are willing to pay the same on advice of exact amount.
3. Enclose the copy of original application to the appeal.
The PIO has 30 days time to provide reply from the date of receipt of your application. Hence I feel you should wait for some more time as the reply may be in the transit. If you do not receive any reply for another one week, you can take steps as suggested above.

No need to pay any fees in RTI appeal.
No need for any affidavit, along with appeal.

Note- the appeal should be filed by your mother only who had applied for the information.

Hi Sir,
Referring to my first query above, I filed a First Appeal to the UPTU authorities on 08-02-2014, but I have not got any response from UPTU authorities till date, nor I have received my degree.
Request you to please suggest what could be the next step taken.

File a petition in consumer court for deficiency of services on part of the appellate authorities for not finishing the information. You will get compensation for mental agony.
For getting the information you can file a second appeal to State Information commission. SIC will advise the authority to give information or face penalty/.

Since you have not received any reply from the first appellate authority, you can very well file second appeal.

File a petition in consumer court. Once the authority receives notice he will prefer to give you information instead of following the case and paying cost of the case.

I feel u should exhaust second appeal first. Going to consumer forum at this stage does not appear necessary.

The difference in following the second appeal and petition in consumer forum is that in the second appeal the authority will be penalized with penalty and the SIC have no powers to force the information to be given where as the forum insist delivery of goods(give information). Also to get result from second appeal is time consuming; the orders of forums are quick.
However having taken a route of first appeal as Expert Mr. M.V. Guptha's opinion you can try second appeal. If you depending on a advocate to fill petition in forum u have to shell out some money where as for second appeal you need not pay any fees.
choice is yours.

Thanks for your reply, Mr. Thyangrajan, I would like to adopt RTI methods at this stage, as I am not getting this much time to engage in to any legal cases as I am working currently.
Secondly could anybody please suggest me how and where to file the second appeal.
