Reference to my mail dt. 31st Aug. One or the expert does not belive that the bankers are not giving statement of account. But it is the fact, the bankers are avoiding to do so. Therefore the only option left with me is to file a petetion against the banker in the court of law which will make them give the statement. One of my seniour also requested them personally but still they did not budge. The Notice dt. Oct 2008 demanding 6Lac+ carry the same contents except for the date and not mention of the payments already made is displayed. It also says that inspite of the notice you have not cared to make the payments.

in reply to notice you can demand detailed statement of account on the basis of which alleged claim of Rs. 6 lakhs is made . no court will pass a decree in favour of bank unless detailed statement of accounts are produced .

Since your repeated demands for statement is not yielding any results specially in the context there is due pending from you, you can ask for compensation by filing a complaint in the consumer Forum.

If you reply to the notice u/s 13(2) claiming certain irregularities in account the financial institution is bound to dispose of your objections otherwise the action under 13(4) shall be illegal.

Dear Sir,
Reference to my problem regarding SARFAESI Proceedings, one of the expert suggested section 17 is appropriate in my case.
Can you please let me know what is section 17. As i am a lay man and do not know about the sections, i will b very thankful if you can give more details about section 17.
