Sale deed lost by bank

Hi,

My sale deed is lost by Bank, My father who is original owner of the house has passed away, Loan was closed way back in 2008 but Bank is unable to locate the sale deed. No Communication has been provided by Bank on this, everytime query is made standard answer we are searching.

what should I do?

You can file consumer complaint against bank for compensation. If you are in Mumbai please contact me for further legal action.

First apply for EC for 40 years in the concerned Registrar Office. Hope you have the Legal Heir Certificate and your father's death Certificate also.Discuss with your Advocate and serve a Legal Notice to the Bank. The Procedure for getting New Sale Deed is First the Bank has to file a Missing Complaint With Police and an News Paper advt to be made in News Paper. After a month a missing suit to be filed in the concerned Court and after proper verification the court will endorse the copy of document with its seal and then onward it would be treated as original. You should also get No Due Certificate from the concerned Bank and if it is a Registered Mortgage the concerned Bank should cancel the same at concerned Registrar Office. Discuss with local Advocate in detail.

Thanks for the prompt reply, but unfortunately I do not have legal heir certificate, but my mother is govt pensioner and legal heir for home.and yes I do have death certificate of my father. Also I wanted to know encumbrance certificate will be provided by Municipal corporation or Lucknow development authority?

You may approach CEPD-RBI, BO, DCDRF... ...

Bank is liable to reconstruct the lost documents....
