Sale of land by gpa holder after the owners death.

(Querist) 13 November 2014 This query is : Resolved
Dear Experts of the Forum,

We are fighting a partition suit and trial court had given Injunction(From March 2011) on the property.
Major property was sold through GPA, which itself is under challenge in the trial court. The above GPA executant had died in the year 2003;this fact was informed to District registrar by submitting the Death certificate of the GPA executant, inspite of this a(Plot) property was registered in April 2013, by using this defunct GPA. What are the options i have; please Guide me.
In the same Property some rectification deed were registered as Self declared rectifications for boundary corrections, declaring The GPA holder are not available, in the year 2012. These properties also under Injunction(From March 2011).Is this action is Correct?

Thanking you ALL.

You said that property was registered in April 2013, but you have not stated that who has executed the document and in whose favour, whether it is sale deed or what type of deed. Facts are not clearly explained. According to my expectation, a fraud, cheating and forgery and perjury has committed by some person.

Apart from the present partition suit, you have to file a criminal case. Basing upon your above clarification, I can give you full opinion on this aspect. Also tell me who has done self declared rectifications before the sub registrar. However the property matters are very complicated. You better contact me ravinder2345@gmail.com or 7893011777 for further clarifications.

If you want proper opinion from this section, you have to furnish full details or if you prefer to contact someone in person, you do so by sending PM to them but avoid this forum. However, to your question, the GPA after the death of principal will be invalid and any transaction done on that basis after the death of the principal will be illegal.
