Sale of property of terminally ill mentally unsound person

(Querist) 09 June 2013 This query is : Resolved 
My father-in-law is terminally ill with cirrhosis of liver with hepatic encephalopathy-diagnosed recently. Just before he became sick, he made an agreement to sale his house and accepted a large amount as advance. Now he is admitted in hospital and doctors are not hopeful of discharging him alive. How can the sale agreement be executed now? To anyone he appears as mentally unsound.

sale-deed can be executed through PoA.

IF HE APPEARS TO BE MENTALLY UNSOUND, THEN EVEN THE POA EXECUTED BY HIM WOULD NOT BE ACCEPTED RATHER IT WOULD GET CHALLENGED.

If the doctor or panel of doctor confirm that he is not of unsound mind at the time of execution of POA, it would be valid.
