(Querist) 06 October 2023 This query is : Resolved
We are sc adi dharavid but my grand father and my father sold sc land to general category
Is this legal
T. Kalaiselvan, Advocate (Expert) 07 October 2023
If it was a land allotted by the government under any scheme for the community people welfare and if the condition period for alienation was over by then, there cannot be any legal infirmity in it, however it would be proper to obtain permission from district collector to sell the property
kavksatyanarayana (Expert) 07 October 2023
Yes. If the land was assigned to them, it requires permission from the District Collector. If the land was not assigned and acquired land they can sell it.
Sudhir Kumar, Advocate (Expert) 08 October 2023
land laws (particularly SC ST land) vary region to region. Meet a local lawyer.
Advocate Bhartesh goyal (Expert) 08 October 2023
Land sold by S.C category to general category is against the law and such sale can be challenged in court and get declared null and void.
Sudhir Kumar, Advocate (Expert) 09 October 2023
The land is liable to be restored to the SC ST and he is not bound to return the price.

However you should meet a lawyer with documents.
