as per sec 24 of Indian partnership act,1932 Notice to a partner, who habitually acts in the business of the firm of any matter relating to the affairs of the firm operates as notice to the firm, except in the case of a fraud on the firm committed by or with the consent of that partner.
i am unable to understand situation of except(exception case)
can i get example of same

partner acts as agent of the firm . notice to agent acts as notice to principal and vice versa . notice must be given to partner who acts as active partner of firm . an exception is made in case of fraud . when one partner acts fruadelently notice to him will not act as notice to firm .

One another meaning of this exception is that if the sender of the notice commits a fraud with such consenting partner then notice to such partner shall not be treated as notice to firm.
Some times sender of the notice make a conspiracy with either of the partners with intent to harm the firm so in that case if sender gives notice to that conspirator then such notice shall not be treated as given to firm.
