Sec. 409 ipc

(Querist) 15 January 2013 This query is : Resolved 
Dear All,
My ex lawyer is in adultery with my wife and theybhad opened bank acounts in joined names as well as bank locker and fd's with the lawyer as nominee. The same lawyer had prepared our family wills and knew all about our properties and monies and then along with my wife filed a marriage petition for divorce.
All the above was done before the filing and while case which is still going on of the divorce and the divorce is yet pending.
Does this attract Section 406, 409, of IPC and is a private lawyer as he himself had claimed that he is at the same time coming under the category of a Public Servant?
Appreciate a detailed answer on how we could apply Sec. 409 of IPC in this case.

406 and 409 is not attracted in the given case but definitely this is a professional misconduct. Such lawyer has no right to remain in this noble profession. Make a detailed complaint supported with the relevant documents to bar Council and do wait its outcome.
