File a suit for injunctions. You can file petition u/s 133 crpc as well.

You should first obtain a report from a building engineer (civil) about the ground situation and reason of the seepage and then should serve a legal notice to your neighbor to stop the seepage failing which file a civil suit for injunction as well as damages, you suffered.

try to settle the matter through some common friends or neighbours before proceeding with legal options.

is your flat istuated in a cooperative society?

if there is a seepage from first floor then the cost of repairs of the toilets ahve to be borne by you and the owner of first floor flat .
