Guest (Querist) 11 April 2015 This query is : Resolved
Hi to all members, me and my wife married as per Muslim sharia in India, then i brought my wife to UAE on my sponsorship ,she went back to India 8 months before by promising me that after the delivery of the baby she will return to me, the problem is form her mother side since she was asking me money for the marriage of her other 2 daughters, which I ignored, then my wife also joined her mother in the game now, and blackmailing me with false cases, fortunately I have all the call recording in my defense. More over there is no communication between our two families due to the same disputes, I just wanted to know being myself in UAE can i send legal notices to my wife and in laws regarding my wife to come and join me here in UAE, since she went to India for delivery of baby and does not want to come to me, and demanding money for settlement etc. etc., which i don’t want to happen, can anyone suggest me what is the procedure to send the legal notices to my wife and in laws and the concern Indian authorities in India, I still love my wife, I want to get back her. I want her to come and join me here in UAE that is all I need from her. Can I do all this procedure without a lawyer???Because previously I hired a stupid lawyer who ditched me for money, who then turn in their side, and threatening me that he will fight the case from their side now. Can I take any legal help from Indian Embassy here????i came to know that they filled a complaint on me, but no FIR yet, because police also understood it’s a false complaint .Can you please tell me what action I can take on my wife and her cruel mother. Can I do all these things with out visiting India???? Thank a lot in advance for your valuable replies.

Last week supreme court of India said that legal notice issued by wife on Facebook itself valid.

So you can issue your notice through mail.. It is also admissible.. But for filing divorce you have to appear before the concern court in India.

welcome..

no you can issue notice to your wife only. regard your matrimonial disputes you can not communicate with any authorities.

just issue notice, then come to india and appoint an advocate for file your case. after that you may back to your job. you need not to be present in all hearings.

your advocate can manage. just you must be present for your evidence. thats all.

If she do not want to join you, move in accordance with personal law to divorce her.

Mr. Victim of wife and in-laws,
1. Why do you conceal your identity with a fake adopted name, if you want some sort of advise from experts on this platform? I desist my learned colleagues to restrain and discourage such author.
2. You have posed faith and hired the services of your so-called "stupid" lawyer, who could not manage to come up to your expectations. However, quoting such unwarranted remarks must have been avoided on this platform where you are seeking charitable expert advise of "lawyers" and not any other professional. It is sincere advise to mend yourself and do not endorse such "stupid" remarks before his/her own fraternity.
3. What sort of notice do you intend to send to your wife who is stated to have deserted you? What do you want to get/gain by sending a legal notice?
4. If you have not received any complaint/ copy of FIR and/or summons, it is premature to form an opinion and advise.
5. You are well off to engage and consult the services of a prudent Indian lawyer(from your own locality/city/town in India) contact, consult and proceed as guided and advised, without dragging this thread.
