He is senior to you as per the merit obtained.

His joining 10 days later is not relevant.
his belonging to BC is not relevant.
What is relevant is that he secured more marks. SO he is senior to you.
The facts given by you indicate that deptt had already planned (though failed) to give injustice to him by placing him in waiting list and placing you in original list whereby he could have been denied job (unless additional vacancies come to operate waiting list) though having secured more marks than you.

You may benefit from the explanation by Mr. Sudhir Kumar.
Soon you may understand if the Lady sincerely wants to unite with you or not! In the interim build some irrefutable evidence that can establish that spouse deserted you and kept you away from newborn child born from wedlock….and if any unreasonable demands were made or allegations were leveled…and you tried to save the marriage… and join the newborn child. Take help of your own very able senior LOCAL counsel of unshakable repute and integrity specializing in Family matters and having successful track record…. A counsel worth his/her salt won’t advise to jump to litigation and shall provide counseling to save the marriage… Remember the spouse may also have valid grounds and irrefutable evidences… Your elders, seasoned well wishers, shrude negotiators ….. and counsel can help you to save the marriage and crease the differences……… and/or build irrefutable evidences and/or strike amicable &C for MCD and/or proceed for contested divorce on merits and valid grounds with irrefutable evidences….

Mr Kumar Doab appears to have wrongly posted the above view probably meant for a marital discord case.
