Seniority in promotion order

My query are two
(i) A DPC has been constituted and in which two persons are promoted. The order contain names of both the persons, my name is at serial no.2. Whether it will mean that I have been made junior to the person whose name is at Sl. No. 2. The order promotion both the person does not disclose any thing about their seniority. Whether I should file an application to the authority for declaration of seniority between both of us.

(2) By the same DPC proceeding two other person has been promoted for another post, one of them comes under SC. The name name of person who comes under SC is shown at Serial No.2. Whether he is also junior to the person shown at Sl No.1.

1) If you are OC, the merit list of DPC recommendation will be the basis of fixation of senioirity in the upper grade of promotion. There is no harm in making representation to ask for the criteria of seniority from the authority.

2) Seniority of SC candidate depends upon the recruitment rules vis-a-vis the available roster point for the SC candidate being filled by the authority.

You have to refer the departmental rules regarding promotion.

The rules are that of the central government which are followed by the Central Administrative Tribunal. So far my query no. 2 is concerned even if there is a roster point is there suppose 3:1 ratio, whether in that if I am the only ST candidate for the said post then whether my seniority will be below the person in the general category because of myself being a ST.

There is a lot of difference in recruitment rules, rules for seniority and the rules of reservation of posts. Only seniority rules and rules for reservation of posts are common for all the departments, but, recruitment rules for different cadres and in different departments are separate from each other. So, you need to check all these rules in combination with reference to the year of vacancy, if reserved for SC/ST candidate.
