Hi ,
I joined BSNL as a JTO and served BSNL from Jan 2002 till 15th April 2007. As per my bond agreement i need to serve 5 years + 4weeks bond agreement , which i served as per me but BSNL claiming bond agreement. I need help to tackle this issue. It is clearly written in bond agreement for 5 years and 4 weeks of training...Also they paid my security money as well after 5 years. Currently they are claiming that i was confirmed on 28th Apr dats why i need to pay bond....pls help in this regard..

You have not mentioned the exact date of joining in January 2002. Even if you have joined on 1st january 2003, your period of 4 months after completion of 5 years would have completed only after 30th April 2007. So you have served BSNL just for 5 years, 3 months and a few days of a month.

If you have not completed the exact period as clearly mentioned in the bond, the action of BSNL is correct.

Thanks all for all your response...in brief..i joined BSNL 21st JAn 2002 and resigned on 15th April 2007..initial 4 WEEKS (Not months) i was on training and getting stiphend only...so as per my uderstanding i have completed 5 yeras 2 months 26 days approx which above 5 years & 4 weeks. I got JTO appointment letter on 28th April 2002..and BSNL is taking this as a referenece. but in BOND agreement no where it is mentioned wrt appointment letter. Clear cut it was mentioned 5 years 4 weeks only...
Pls suggest further...

Service of open market recruits starts from the date of actual appointment after completion of training. Training with stipend is not treated as service period. Had you ben paid full salary during training period also, you could have been treated as on duty in regular service from the very beginning of your training.
So, your total period of service would be counted from the actual date of taking over of charge of the post of JTO after issue of your appointment order, dated 28th April, 2002.

Hi Sir...
It is clearly mebtioned in Bond period that employee need to serve 5 years and 4 weeks of Aforesaid training...Along with that employee will get Stiphend along with Dearness allowance as well during this tarining period.
Even though i am good to justify as per bond agreement that i have served as per bond agreement "Atleast 5 years after aforesaid training of 4 weeks".
Should i send you to copy of bond agreement. Also after this bond agreement i was posted in Raipur taking care of field operations but again it was field training for 10 weeks..
No where in BOnd agreement it was mentioned that after appointment i need to serve for 5 years..Since i woked in field for more than 5 years. Stiphend was mentioned in bond for 4 weeks only not for other 10 weeks...but unfortanetly we were given stiphend for next 10 months as well...
In next batch BSNL rectify this mistake and clearly mentioned 14 weeks as tarining period.
Need your help in this sir..

You have posted that:

If this is the case and no corrigendum etc was issue to you and accepted by you, the verbatim reading and application of the Bond signed by you may offer you reprieve.
It is believed your training was not extended in writing.
Did no one object in writing under acknowledgment for being paid stipend in place of salary for additional 10 months?
The employer may not be counting this additional period of 10 months in service.
You have shown your inclination to show the bond.
It is the right thing to be done.
Show not only the bond, the appointment letter, salary slips, all communications, give inputs, spend quality time to discuss with your counsel and proceed under expert advice of your counsel.

OK, if you feel you are justified in your interpretation and have served 5 years + 4 months of training period, you can challenge the BSNL legally. Hire services of some local lawyer and convince him, as per your understanding by showing the copy of the bond and try your luck.
