Service bond - travel

(Querist) 28 January 2016 This query is : Resolved
Hello ,

My company has sent me outstation on training for a month, 3 months back. I had been previously travelled twice from the company with agreement of 1 year service bond and both the bond period got expired. However during my last travel no one approached me for any bond and even during travel and after 1.5 months reaching india no one ever approached me bond. By the mean time i got a new opportunity in another organisation and want to leave the organisation. But the company is forcing me to sign bond else threataining to take legal action.

I have also put down my paper.

Please advise and suggest.

It appears that the Bind earlier executed is not renewed . if that is so there is contractual bar to join new company.
At this stage do not execute a fresh bond.

Prima the legal action is an empty threat.

Record all such threats (audio/visual/minuted/witnessed).

Download the copies of previous bonds signed by you and also performance record showing NO transgressions by you and unblemished service, appraisals, rewards,awards.......etc

Tender notice of resignation under proper acknowledgment (mention LWD) , final resignation and mention that to whom you should handover the charge under proper acknowledgment on the spot.

Mention (record)to one and all in gentle manner that since NO Bond is signed by you hence no Bond is applicable to you and NO Threat be made to you.

Are you a member of employee's/trade unions?

It shall be better to get all employment, travel, related documents and Bonds examined by your able Labor Law/Service matters Consultant, beforehand and proceed with caution and not to fall in traps.

If you have opportunity to join another organisation, do not sigh any bond now.
