Sir,
Currently I am working in a law firm as an associate advocate. My boss owns a consultancy as well as a chartered accountant office. Sir more than one month has passed but he is not paying the salary to his employees of consultancy and again and again saying that I will pay tomorrow. Sr the due date of salary is 07 of every month and their appointment date is 01 and all of them have offer letter as an evidence as well as ID cards of company.
Sir what is the proper forum before which their case should be filed?
Is it a labor court?
Sir a legal notice should be served in such a case or not and if yes then what they can seek and what type of compensation can they ask from him in labor court.
Sir kindly tell me the proper procedure and proper court where this case can be filed.
Sir he is in the habit of not paying his employees and I want to teach him a lesson please help.

You say you work for a law firm then how come your so called boss(senior) carry on consultancy and a CA firm, since under BCI rules your senior is not supposed to hold any executive position in any business interests and while professing as an advocate he cannot carry on with the profession as a CA. Clarify and give correct facts of the case.

He is a lawyer for name sake only, he is not practicing as an advocate.

Sir he has not given me and other lawyers working in the firm any offer letter so if eh refuse to pay our salary then under what section can we sue him?

You can complain to the Bar council of your state.

He harass the other junior lawyers in a very bad way. He called other juniors lawyers as donkey, stupid, idiot because they haven't work in courts and have came from other law firms. Can we complaint to the Bar Council of DELHI against such a person?

Such pathetic issues which demoralizes the ethics of this noble profession must be dealt with iron hands. There must be specific legislation to cover such issues besides BCI regulations.

File a complaint against your senior to BCI and also Labour Court for recovery of monthly Salary. You can filed case against your boss in Labour Court without doubt.
