Service period for gratuity eligibility

Sir, Can one give me clarity over the gratuity eligibility for an employee for an org. working 6 days a week and an org. working 5 days a week with exact period of service required.

An employee who has completed continuous service of 5 years with an organisation is eligible for the gratuity.

Definitely you are right sir, but if working policy is 5 days or 6 days then there may be difference in the days of service period reqd. As per my knowledge it is 240/365 days conti. service for 5 yrs.

An employee rendering continuous service for a period of 240 days in a year will be deemed to have continued in service for 'one year'.

Qurist has come to experts so it is out duty to convince him on the basis of some logic.

Requirement of 240 days continuous service is must for 5 years to become eligibble for gratuity whereas work is for 6 days per week and it shall be propertionaly decreased in case there is a rule of 5 days work and 2 days rest.
