If a firm supplys packed lunch on order to a place of the receiver, is the service tax is applicable?Kindly note that the food is to be prepared at a place of the service provider and simply supply the packed lunck.

Service for just supplying the packed lunch is not covered in any of the taxable services

If the food is prepared by you, no matter even if at the place of service reciever and then u supply it to the reciever, then u r liable to pay service tax. However, if the food is prepared by someone else and u r just engaged in packing the food, then u r nt liable to pay service tax.

In a recent Tribunal Judgment it has been held that if food supplied to a convention centre, separately billed and if vat has been charged on the food value, no service tax is applicable.

Such kind of activity is not covered under the definition of Outdoor Catering services which are liable to service tax as per section 65 of the service tax law.
