I want to surrender my Service Tax code due to not carrying on the business.I have never any income.I have not filed any Return.Whether penalty is applicable.

yes penalty is applicable . you are required to file your returns half yearly . failure to file reurns attracts penalty . it is in your interest to surrender your certificate if you have ceased to provide taxable service

Even nill return is compulsory.Below ceiling limit turnover you may file Nil tax collection, to show gross income which are not covered upto 9 lacs.Do not late to submit ST3, which should be in regular.
