sets of proofs provided are gien to the opponent?

(Querist) 16 March 2010 This query is : Resolved
Dear experts,
Mr X is facing a false complain and may be required to pass through the regular bail process. The query is: Will the complainant's advocate be given the copies of all proofs by Mr X's (advocate) to the court in the bail process.?
If yes, then what is the remedy for the same?
Devajyoti Barman (Expert) 17 March 2010
The original documents or its copies is to be submitted only before the court for its consideration and not to the complainant. However the complainant has got right to have a look on it to question its genuineness,
Raj Kumar Makkad (Expert) 17 March 2010
No. There is no such legal requirement as no such provision exists in Criminal Procedure Code.
B K Raghavendra Rao (Expert) 17 March 2010
It is legally not required to furnish copies of the documents relied upon by the Accused to the counsel for Complainant. Counsel for Mr. X should refuse to give copies.
