under what provision of law we can say settlement deed is not entitle for partition if the party files a partition suit can we dismiss the same by presenting the settlement deed or not

Settlement Deed and partition deed are two different and distinct things. In settlement, the consent of all parties is must but in partition deed, it may not be there. In either of the situations, no deed discards other under any law.
