Settlement deed

(Querist) 20 February 2012 This query is : Resolved 
my grandfather had two sons,one of my father. my grand father had some self acquired property.After my grandfather's demise my father and my uncle were devide the above said property into two equal shares by oral partition. Now my father has settled his share to his illegal wife by way of a registered settlement deed.now my mother was expired. can I entitled to claim my share from my father?

You can very well claim your share. You can file a suit for partition and seperate possession. You can also obtain the declaration that the settlement deed is illegal and is not binding upon your share.
